ACTION REQUESTED:
Title
Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning & Zoning Commission and Staff to ADOPT an ORDINANCE Amending APPENDIX A, the Unified Development Code, Relating to DONATION BINS.

Body
BACKGROUND: Currently donation bins are prohibited unless placed on the parcel on which the donation collection entity operates a principal business. Staff is proposing to allow donation bins on parcels zoned commercial, industrial, and form districts subject to the following requirements:
* Limit of one per parcel
* Maximum dimensions of 48" wide, 48" long, and 83" tall
* Property owner must provide consent and will be held responsible for any violations
* Must be placed on a hard surface
* Prohibited from the required front yard
* Prohibited on vacant parcels or parcels without an active, legal, principal use
* No advertisement except for sponsoring organization and contact information
* The area surrounding the donation bin must be kept clean
* The placement of the bin cannot interfere with traffic circulation

A Verification Certificate (at no cost) will be required prior to placement of a bin to ensure that the property owner has provided consent and to maintain an inventory.

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 3 to 1 to approve the text amendment.

IMPACT IF APPROVED: Donation bins may be placed in commercial, industrial, and form districts subject to the regulations outlined above. These regulations may result in an increase in the number of donation bins as their placement will no longer be restricted to the property of the donation business.
