Communication from the City Manager and Corporation Counsel with a Request to APPROVE the SITE APPLICATION to add a Subclass 1A (2:00 AM Closing Hours) to an existing Class B (Restaurant, 50% Food) Liquor License, with the Retail Sale of Alcohol at PIONEER SMOKEHOUSE & SALOON, 1112 W. PIONEER PARKWAY, with a Recommendation from the Liquor Commission to Approve. (Council District 5)

BACKGROUND: Ms. Stephanie Lillig, Owner, submitted a Site Application to add a Subclass 1A (2:00 a.m. closing hours on Thursday, Friday & Saturday) and a *Subclass 3 (beer garden) to an existing Class B (restaurant, 50% food) Liquor License with a previously approved Subclass 2 (live entertainment) at 1112 W. Pioneer Parkway. The Liquor Commission voted unanimously to recommend approval of the addition of the two new subclasses, contingent upon compliance with all of City of Peoria Codes. After the meeting the owner entered into an escrow agreement with the Community Development Dept. and also submitted a deposit for outstanding work at Pioneer Smokehouse. Minutes of the Liquor Commission Meeting are attached.
*Note: For this request, the addition of the Subclass 3 (beer garden) does not require Council action and is acted upon only by the Liquor Commissioner.

IMPACT IF APPROVED: Alcoholic beverages can be sold and consumed at this site as a restaurant until 2:00 a.m. on Thursday, Friday and Saturdays.
IMPACT IF DENIED: This site will continue to serve or sell alcohol as a restaurant until 1:00 a.m.
