Communication from the City Manager and Corporation Counsel Presenting ORDINANCE OPTIONS Regarding HUNTING with a BOW and ARROW within the City Limits.

BACKGROUND: Currently, the City follows State law which provides that it is illegal to bow hunt within 100 yards from an inhabited dwelling unless the hunter has permission from the owner or tenant of that dwelling to hunt on that property.  From time to time, City Council Members have been approached to make this 100 yard requirement more stringent.  Staff has attached the previous Council Communication from 2013 as well as a memorandum from the former Chief of Police, Steven Settingsgaard, discussing this issue.  Since 2013, when this issue was last discussed, four complaints have been made.  At this time, Staff is merely providing four alternatives for the Council to consider and not making any recommendation as to any alternative.
 
FINANCIAL IMPACT: None.
 
NEIGHBORHOOD CONCERNS:   City Council Members have received communications from landowners concerned about neighbors hunting with a bow and arrow near their houses.
      
IMPACT IF APPROVED:  Depending on the option selected, the rules for hunting will change in the City.
 
IMPACT IF DENIED:   Hunting will continue to be permitted in the City as allowed by State law.
 
ALTERNATIVES:   
A)  Make no change in Ordinance allowing State law to apply.
 
B)  Hunting with a bow and arrow will be permitted if hunting occurs 150 yards away from an inhabited dwelling or with the permission of the land owner or tenant.
 
C)  Hunting with a bow and arrow will be permitted if hunting occurs 150 yards away from any property line or with the permission of the land owner or tenant.
 
D)  Hunting with a bow and arrow will only be allowed on parcels consisting of two or more acres.
 
E)  Hunting with a bow and arrow will not be allowed within the corporate limits of the City.
