A.      ORDINANCE A Amending APPENDIX B, the Zoning Ordinance, Related to ELDERLY HOUSING; and
 
B.      ORDINANCE B Amending APPENDIX C, the Land Development Code, Related to ELDERLY HOUSING.

BACKGROUND:  
Staff is continually working to simplify zoning regulations to improve customer service, encourage development, and allow for more economic development opportunities in Peoria.  Review of the Zoning Ordinance and Land Development Code (LDC) found numerous terms related to the same type of use: elderly housing, nursing homes, congregate housing, full-time convalescent, life care center, assisted living facility and hospice.  These terms currently require a special use in select residential and commercial districts.  However, there are inconsistencies between the Zoning Ordinance and LDC and the numerous terms.  For example, elderly housing is a special use in single family and multi-family residential districts while a nursing home is a special use in multi-family districts only.  In the Zoning Ordinance, hospices are a permitted use in the N-1 Institutional zoning district; however, in the Land Development Code, hospices are not permitted in the N-1 Institutional zoning district.
 
In the past, senior housing facilities provided one form of service such as nursing home or assisted living.  More recently, senior housing developments have sought to provide comprehensive housing services beginning with independent living and progressing to memory care.  This is evident with Buehler Home, Lutheran Hillside Village, Liberty Village, Proctor Home, and Bickford Senior Living Facility.  The inconsistency of current regulations and Codes make it difficult to provide complete housing services within one development.
 
To address the differences and simplify the codes, staff is proposing the following changes:
1)      Collapse Elderly Housing, Nursing Home, Congregate Housing, Full-time Convalescent, Life Care Center, and Hospice into one use category called Assisted Living Facility and allow as a special use (no change) in residential and commercial districts.
2)      Add Assisted Living Facility as a Special Use in the A1 Agricultural and RE Residential Estate zoning districts.
3)      In the LDC, add Assisted Living Facility as a permitted use in the N-1 Institutional zoning district.
4)      Add a definition for Assisted Living Facility to define and clearly describe the intent of this term to include the various forms of senior and medical-related housing.  
5)      Strike the definition for congregate housing.

IMPACT IF APPROVED: Various terms relating to elderly housing will be collapsed into one use category called Assisted Living Facility and allowed as a special use in agriculture, residential and commercial districts and as a permitted use in the N1 Institutional district.  An Assisted Living Facility will be defined to include a combination of housing and supportive services for persons due to age or medical condition.  The definition of congregate housing will be removed.
 
IMPACT IF DENIED:  The Codes will remain unchanged with conflicting regulations using various terms related to elderly housing.
