DILLON, INC., and to Authorize the City Manager to Execute the Change Order to Add $750,000 to the Budget, for a Total 2021 Budget Amount of $1,650,000.00 (Reference 19-059,19-142, and 21-029) [All Council Districts]

BACKGROUND:  This annual contract has eliminated the delays experienced waiting for the designing, bidding, letting and Council approval of individual contracts for each repair project.  The repairs are designed “in the field” and paid based on a time and materials bid.  This approach allows the Public Works Department to continue to be responsive to residents with drainage concerns caused by failing city-owned storm sewer infrastructure.

 

Increasing the value of this year’s budget will help reduce the backlog of these repairs. J.C. Dillon has been making a lot of progress on repairs this year and need additional funding to continue completing projects on the stormwater backlog list. 

 

J.C. Dillon was the low bidder for this contract in 2019 and the contract allowed for an up to three one-year contract extension. The original unit prices bid shall remain in effect for the contract extensions.  Any equipment or material costs that have increased 25% or more from the time of the original 2019 bid will be evaluated for an increase on a case by case basis. The contract change is germane to the original contract as signed.

 

J.C. Dillon is a local business and has successfully and satisfactorily performed work under this contract for the City. The work performed under this contract is specialty work that does not offer sub-contracting opportunities.  The low bidder agreed to make sure they meet the City’s workforce utilization goals of 18% minority and 3% female on this project.

 

In 2020 on this contract, the minority workforce utilization was 29.3% (18% goal) and the female workforce utilization was 0% (3% goal).

 

The Prime Contractor and all its subcontractors are to make a good faith effort to comply with the following GOALS for minority and female participation.

 

1.Eighteen (18) percent of the total hours worked, per trade, to be performed by minority workers.

2.Three (3) percent of the total hours worked, per trade, to be performed by female workers.

3.Ten (10) percent of subcontractor work to be performed by minority subcontractors.

4.Five (5) percent of subcontractor work to be performed by female subcontractors.

Public Works engineering staff and consultants will oversee the contract.

FINANCIAL IMPACT:  This change order requires a budget amendment to add funds to the project. There are stormwater utility funds available that can used. This is project number o2103.

 

NEIGHBORHOOD CONCERNS:  Storm sewer failures are a safety risk to the public. Well-maintained infrastructure is an asset to neighborhoods.

                     

IMPACT IF APPROVED: Additional repairs will be completed thus reducing the list of stormwater backlog projects.

 

IMPACT IF DENIED:  Additional repairs will not be completed. Stormwater backlog projects will be delayed until future years when those repairs may be larger and more expensive.
