BACKGROUND: Attorney Joe VanFleet presented a Site Application for a Class B-1 (restaurant, 25% food) Liquor License, with a Subclass 3 (beer garden) for 6736 N. Frostwood Parkway (d/b/a Po-Boy's on Frostwood). After some discussion, Attorney VanFleet amended the subclass site application from Subclass 3 (beer garden) to Subclass 3a (sidewalk café) The Liquor Commission voted unanimously to recommend approval of the Class B-1 site application and the amended Subclass 3a (side walk café) application. Minutes of the Liquor Commission Meeting are attached. The City Council only votes on the Class B-1 site application and if approved, the Liquor Commissioner or the Deputy Liquor Commissioner may approve the request for site approval for Subclass 3a (sidewalk café).

NEIGHBORHOOD CONCERNS: A resident who represented the Neighborhood Association stated that the Association had no outright consensus against or for the proposed establishment. Two letters of concern were submitted by neighborhood residents in regards to the request for a Subclass 3 (beer garden). Copies of these letters are included in the attachment. After discussion, the applicant amended its subclass request to a Subclass 3a (sidewalk café).

IMPACT IF DENIED: This site will not be approved to serve any kind of alcohol.
