Communication from the City Manager and the Director of Community Development with a Recommendation from the Planning and Zoning Commission and Staff to Adopt an ORDINANCE Amending Appendix B, the Zoning Ordinance Related to YARD REQUIREMENTS in the Class O-2 (Exclusive Office Park) District.

BACKGROUND:  
The O-2 zoning district is intended in part to encourage the development of campus-type office environment protected from incompatible uses.  The zoning ordinance currently states that the minimum lot size in O-2 is two acres but that it may be further subdivided into smaller lots.  
 
What the Zoning Ordinance does not specify is whether the yard setbacks may be applied to the original larger lot, or must be applied to the further subdivided smaller lots.  Applying the yard setbacks to the original larger parcel allows the campus-like office setting with shared access and parking.  This also reduces the amount of impervious surface which in turn helps control storm water run-off.  Applying the yard setbacks to the individual smaller lot creates challenges to provide frontage for each lot and prevents sharing of parking lots.  As a result, the intent of the O-2 zoning district is not achieved when the yard setbacks are required for the smaller subdivided lots.
 
The proposed text amendment allows the yard setbacks to be applied to the originally platted standard lot.   This encourages the campus-like setting with shared access and parking.  
 
PLANNING & ZONING COMMISSION ACTION:
The Planning & Zoning Commission found that the request met the Findings of Fact requirements and VOTED 7 TO 0 TO APPROVE.

IMPACT IF APPROVED:  The Zoning Ordinance will be amended to clarify the yard setback requirements in the Class O-2 district.
 
IMPACT IF DENIED:  The Zoning Ordinance will not be amended and the yard setback requirements in the Class 0-2 district will remain unclear.  Unclear regulations may make it difficult for development to meet the district requirements.
