Title
Communication from the City Manager and the Community Development Director with a Recommendation from the Planning and Zoning Commission and Staff for the Following:
 
1)      ADOPT an ORDINANCE Amending APPENDIX B, the Zoning Ordinance, of the CODE of the City of Peoria with Respect to ROADSIDE PRODUCE STANDS, and
 
2)      ADOPT an ORDINANCE Amending APPENDIX C, the Land Development Code, of the CODE of the City of Peoria with Respect to ROADSIDE PRODUCE STANDS. PZ CASE NO 14-G.
 
Body
BACKGROUND:  
In an effort to further support urban gardening and to continue to increase access to healthy affordable food, Staff is proposing a text amendment to allow roadside produce stands in the C-1 (General Commercial) and C-N (Neighborhood Commercial) Districts.  Note that this use is already permitted in the A-1 (Agricultural) District and will continue to be.  In addition, the text amendment proposes to allow home-produced fruit and vegetable sales in residential districts or accessory to a legal non-conforming residential dwelling in a non-residential district.  
 
Roadside produce stand means any trailer, tent, table, operable motor vehicle, or other temporary structure, not erected on a foundation, for the sale of seasonal whole, uncut fresh produce, not customarily sold on a year-round basis.  Home-produced fruit and vegetable sales are limited to the sale of fruits and vegetables grown at the residence where the sale is occurring and may not take place more than 3 times per year, with each sale lasting no more than 3 days.  
 
The purpose of a roadside produce stand and home-produced fruit and vegetable sales is to allow groups and individuals, who are actively farming, low cost entrance into direct marketing their produce. It is characterized as a direct marketing operation without a permanent structure and only offering outdoor shopping. Such an operation is seasonal in nature and features locally grown fresh produce.
 
ZONING COMMISSION ACTION:
The Planning and Zoning Commission found that the request met the Findings of Fact requirements and VOTED 5 TO 0 TO APPROVE.

IMPACT IF APPROVED: Roadside Produce stands will be permitted in the C-1 (General Commercial) District and C-N (Neighborhood Commercial) District and Home-produced fruit and vegetable sales will be permitted from residential dwellings 3 times per year.  
 
IMPACT IF DENIED:  The Zoning Ordinance and Land Development Code will not be amended to allow roadside produce stands and home-grown fruit and vegetable sales.
