BACKGROUND: Petitioner Chris Oswald for Kroger Limited Partnership I is requesting to amend two existing Special Uses to:

1) Remove 0.68 acres of property, currently owned by RLI, from its special use boundary and add to the adjacent special use boundary for Kroger. The property is currently part of Parcel Identification No. 09-32-451-014; and

2) Construct a 20,800 sq. ft. building addition to the Kroger grocery store and parking lot expansion.

 

The Planning & Zoning Commission found that the request met the Findings of Fact requirements and VOTED 5 TO 0 TO APPROVE the request subject to the following conditions and waivers:

 

1)                     Provide a revised landscape plan which includes additional parking lot peninsulas, landscaped with trees, along the east property line.

2)                     Replace non-ADA-compliant curb ramps at the north and south entrances on Lindbergh Drive. Such replacement shall include sidewalk cross slope through drive approaches shall be no steeper than 2%.

3)                     Special event and/or sales located in the parking lot or private building sidewalk may occur provided that any tents or other temporary covered structures and any temporary signage shall comply with all Codes of the City of Peoria.

4)                     Waiver to reduce the required front yard setback from 20 feet to 10 feet.

5)                     Waiver to allow banners on all light standards in the parking lot. Size of banners must comply with current zoning regulations.

FINANCIAL IMPACT: N/A

 

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission meeting):   A citizen spoke in support but with concern that the parking spaces along the north property line may interfere with storm water drainage.  In response, the petitioner stated that all proposed construction would be in compliance with the City’s storm water regulations.

                     

IMPACT IF APPROVED:  The boundary of the special use for Kroger will be amended to add 0.68 acres from the adjacent land to the south.  A 20,800 sq. ft. building addition may be constructed on the south side of the Kroger store and a parking lot expansion may be constructed with a reduced required front yard setback to 10 feet.

 

IMPACT IF DENIED:   The boundary of the special use for Kroger will not be amended, nor will a building addition to Kroger or parking lot expansion be permitted.
