ACTION REQUESTED: 

Title

Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning & Zoning Commission and Staff to APPROVE a RESOLUTION Approving an ANNEXATION AGREEMENT for the Property Located at 9818 N ALLEN ROAD (Parcel Identification Nos. 09-31-251-008 and 09-31-251-011), Peoria IL

 

Body

BACKGROUND:  Petitioner Ken Lynch of KTL Holdings, Inc. is requesting approval of an annexation agreement for 13 acres of land located at 9818 N Allen Road.  The land is partially developed with an approximately 5,000 sq.ft., two story commercial building.  The property also includes a wireless communication tower facility.

 

Proposed terms of the Annexation Agreement include:

1)                     Property shall be zoned Class C-2 (Large Scale Commercial).

2)                     Connection to public sanitary sewer and water required upon non-agricultural development of the property.

3)                     Annexation to occur upon expansion of existing building, new or additional commercial/industrial development/uses, or failure of existing septic system.

 

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 7 to 0, to APPROVE the request.

FINANCIAL IMPACT:  No expense to the City of Peoria.  Additional tax revenue upon annexation and development.

 

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission Meeting):  Two representatives from the Dunlap Library District objected to the annexation due to the loss of tax revenue.

                     

IMPACT IF APPROVED: An agreement for annexation will be approved.  The property will be annexed into the City upon development or expansion of the existing building.  Upon annexation, an ordinance rezoning the property to C-2 Large Scale Commercial will be forwarded to City Council for approval.  A preliminary plat for the division of the land into two parcels will be reviewed administratively.

 

IMPACT IF DENIED:  An agreement for annexation will not be approved. The property will not be annexed or subdivided.
