(Council District 5)

BACKGROUND: The subject parcel is adjacent to parcel PIN 13-02-103-001, which was rezoned in October 2015 to a Class R-3 (Single Family Residential) district for a proposed assisted living facility. It was noted at the October Planning & Zoning Commission meeting that this subject parcel, which is an unbuildable, natural buffer area, was intended to be rezoned concurrently with the adjacent parcel but did not meet the legal notification requirements. As a result, the subject parcel was not rezoned.
The Planning & Zoning Commission found that the request met the Findings of Fact requirements and VOTED 6 TO 0 TO APPROVE.

FINANCIAL IMPACT: N/A
IMPACT IF APPROVED: The subject property will be rezoned to Class R-3 (Single Family Residential), which creates uniform zoning of the area.
IMPACT IF DENIED: The subject property will not be rezoned to Class R-3 (Single Family Residential). The property will remain Class O-1 (Arterial Office), which leaves an undesirable “spot zoning”.
