Title

Communication from the City Manager and Director of Community Development with a Request to Concur with the Planning & Zoning Commission and Staff to Adopt an ORDINANCE Amending Appendix A, the Unified Development Code, Relating to DUPLEXES and the B1 DOWNTOWN COMMERCIAL DISTRICT.

BACKGROUND:  The recent merger of the Land Development Code and Zoning Ordinance resulted in an unintended regulation that now requires all proposed duplex lots to be created through the subdivision process.  This means multi-family lots which are zoned for multiple dwelling units currently require a subdivision plat to create a duplex lot.  This is not necessary when the zoning district itself allows for multiple dwelling units.  The attached ordinance corrects the duplex regulation to the original requirement of a subdivision plat for single family residential districts only.  Duplexes in multi-family zoning districts will not require approval through a subdivision plat. 

 

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 4 to 0 to APPROVE the proposed text amendment.

Another recent text amendment added density limitations for apartments developed in non-residential zoning districts without an exception for the B1 downtown commercial district.  The attached ordinance also removes the B1 zoning class from residential density limitations.

IMPACT IF APPROVED: The Land Development Code will be revised to eliminate the requirement of a subdivision plat for duplexes in multi-family residential zoning classes.  A plat will continue to be required for new duplex lots in the single family residential zoning classes of RE, R1, R2, R3, and R4.

 

IMPACT IF DENIED:  The Land Development Code will not be modified and a subdivision plat will be required to create a duplex lot in all residential zoning classes.
