A.      To Accept the BID of the Lowest Responsible Bidder, MILENNIA PROFESSIONAL SERVICES, and AWARD the Base Construction CONTRACT for the DR MARTIN LUTHER KING JR DRIVE (Formerly Seventh Street) RECONSTRUCTION PROJECT, in the Amount of $430,397.90, with Additional Authorization of $19,602.10 in Contingency for a Total Authorization of $450,000; and

BACKGROUND:  
The request to award this construction contract was sent to the Regular City Council meeting on January 28, 2014. Council deferred the request to the February 25, 2014 Regular Council meeting in order for Staff to review for a different funding stream for the proposed reconstruction project, in lieu of Southtown TIF funds.  Council elected to defer the item again to the March 25, 2014 Regular City Council Meeting requesting staff to continue to look for alternative funding mechanisms.  This project is "shovel-ready."  
 
Currently, the MacArthur Highway Bridge project is under contract for engineering services in the amount of $64,500 for the development of a bridge report to ascertain the most feasible option for its improvement; however, the Project has a budget of $600,000. This project does not have to be constructed during 2014.  Construction is projected for 2018, at which time the IDOT's Illinois Major Bridge Program funding in the amount of $4.84 million will be utilized.
 
Restatement of INFORMATION FROM JANUARY 28, 2014 Counsel Item:
 
The present condition of the slope on the north side of Dr. Martin Luther King Jr Drive (formerly Seventh Street) between Richard Allen Drive and Union Street is deteriorating due to storm water flows eroding areas on the steep slope. The Dr Martin Luther King, Jr. Drive Reconstruction project will consist of constructing a new retaining wall to stabilize the slope, installing a new ADA accessibility crossing at Union Street, and repairing the brick pavement on King Drive as needed.

Staff is recommending acceptance of the lowest responsible bid for the project rather than the first low bid.  The apparent low bidder, Krumholz Brothers Landscaping, does not currently satisfy the City of Peoria's Purchasing Ordinance, Section 10-111(5). This Section requires a responsible bidder to participate in an Illinois Department of Labor accredited training and apprenticeship program for all trades of work contemplated under the award of a public works contract in excess of $100,000. Krumholz Brothers Landscaping did not adequately meet this City Purchasing Ordinance as of the bid date, as they did not have an accredited Apprenticeship or Training certification for their Laborers.
 
Millennia Professional Services is the lowest responsible bidder meeting the Purchasing Policy and is a local business that has successfully performed work for the City in the past.
 
The Good Faith Efforts documentation provided by Millennia Professional Services of Illinois has been reviewed and approved by the Equal Opportunity Manager. Since Millennia is a Minority Business Enterprise (MBE), their participation satisfies this goal and the company plans to utilize a Woman Business Enterprise (WBE) to perform trucking services equaling seven percent (7%) of the bid amount.
 
Infrastructure Engineering, Inc. will be performing Construction Engineering services through their Master Engineering Services Agreement which Council approved on July 24, 2012.
 
 
FINANCIAL IMPACT:  $450,000 in funding for the Martin Luther King, Jr. Drive Reconstruction Project (T12009) will be utilized from T12007, the MacArthur Highway Bridge Project.
 
NEIGHBORHOOD CONCERNS:  Temporary Construction Easements were needed on this project. The City and its ROW Consultant, Terra Engineering, have met with and made arrangements with the 6 parcels affected by this project. Communication will be ongoing with property owners throughout the project.
      
IMPACT IF APPROVED: The project will be constructed this year.
 
IMPACT IF DENIED:  Staff will look for direction from Council.
