Communication from the City Manager and Director of Public Works with a Request for the Following:
A. ACCEPT the LOW BID from STARK EXCAVATING, INC., in the Amount of $1,265,139.00, and APPROVE a CONTRACT for Culvert Replacement Carrying the East Branch of Dry Run Creek Under MERLE LANE, with an Additional Authorization of $126,861.00 (10%) for Contingencies, for a Total Award of $1,392,000.00. (Council District 2)
B. ADOPT an ORDINANCE Amending the City of Peoria 2022 BUDGET to Allocate $881,000.00 from the Stormwater Utility Fund Balance for the MERLE LANE CULVERT REPLACEMENT PROJECT.

BACKGROUND: The project consists of a new culvert to replace a deteriorated corrugated metal pipe culvert carrying the East Branch of Dry Run Creek under Merle Lane just west of Knoxville Avenue. The project includes stabilization of the channel at the upstream and downstream ends of the new culvert, rerouting of an existing 24” sanitary sewer within the stream channel to allow for the construction of the new drainage structure, and restoration of the area with trees, shrubs on grass.
The contract was advertised on August 8th and 9th and bids were opened on September 7th with the following bids received:

Midwest Engineers prepared the bidding and contract documents.
The work will be completed based on bid unit prices. Public Works staff is recommending adding a 10 percent contingency to account for unknown conditions that are encountered as the work is performed.
Stark Excavating has successfully performed work for Peoria in the past. Stark Excavating proposes to use JD Traffic (WBE), Central Landscaping (WBE), Kerri Brown Trucking (MBE), and Kadilex Construction (MBE). The M/WBE work to be subcontracted amounts to 3.5% (10% goal) for MBE and 2.4% (5% goal) for WBE of the contract bid. Stark completed the Waiver Request and provided documentation of their efforts to engage M/WBE contractors. Documentation was reviewed and approved by the Chief Diversity and Inclusion Officer.
On the Prospect Humbolt Wall Project Stark’s minority workforce hours were 12.3% (18% goal) of the total hours worked and the female workforce hours were 0% (3% goal) of the total hours worked.
The budget amendment will also cover some of the construction engineering costs.
FINANCIAL IMPACT: The project is budgeted in the 2021 Community Investment Plan as Project Number O2106.
NEIGHBORHOOD CONCERNS: Potential problems due to the deterioration and failure of the culvert would create significant damage to the neighborhood.
IMPACT IF APPROVED: Flow conditions of the East Branch of Dry Run Creek will be preserved and the threat of property damage due to flooding will be mitigated
IMPACT IF DENIED: Flow conditions within the floodplain pose a significant risk to private property and public streets if the existing culvert is not replaced.
