Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning & Zoning Commission and Staff to APPROVE a RESOLUTION Approving an ANNEXATION AGREEMENT for the Property Located at 9601 N. ALLEN ROAD (Parcel Identification No. 09-31-300-007), Peoria IL.

Body

BACKGROUND:  Petitioner Bill Hoerr is requesting approval of an annexation agreement for 17.05 acres including a subdivision plat creating three lots.  The property is contiguous to the City boundary and proposed to be zoned Class I-1 (Industrial/Business Park). 

 

The proposed annexation agreement terms are:

1)                     Rezone (upon annexation) property to Class I-1 (Industrial/Business Park) District.

2)                     Non-agricultural development of the site will require connection to public water and public sanitary sewer.

3)                     Subdivide into 3 lots - subdivision plat reviewed through the administrative process.

4)                     Conditions for annexation of each lot.

5)                     Allow existing gravel lots to remain.

 

Once the subdivision plat is recorded, ordinances to annex and rezone Lot 1 will be brought back to Council for review and approval.  Lots 2 and 3 will annex at a future time when the earliest occurrence of non-agricultural development, the existing septic system fails, or the lots are further subdivided, or 15 years from the date of the annexation agreement.

 

The Planning & Zoning Commission voted 5 to 0 to Approve the request with a condition to revise the annexation agreement eliminate the sidewalk requirement along the frontage with the intent to align sidewalks with the existing pedestrian crossing across Allen Road on the north side of Van Winkle Way. The Petitioner and Staff concur with this recommendation and the attached annexation agreement has been revised accordingly.

FINANCIAL IMPACT:  Additional tax revenue will be collected for the annexed property.

 

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission Meeting):  Residents of the adjacent residential subdivision expressed concerns for noise and light pollution, the smoke produced by outdoor burning, and lack of screening around the property.

                     

IMPACT IF APPROVED:  The property will annex to the City of Peoria per the terms of the annexation agreement.  Lot 1 will annex following approval of the subdivision plat.  Lots 2 and 3 will annex when certain contingencies are met but no later than 15 years from the date of the annexation agreement.

 

IMPACT IF DENIED:  The property will not annex to the City of Peoria and will remain in Peoria County.
