Communication from City Manager and Director of Public Works with a Request to ADOPT and APPROVE  the Following Regarding Recent Improvements to the OSF HEALTHCARE SYSTEMS' DOWNTOWN CAMPUS:
 
A.      ADOPT an ORDINANCE VACATING Approximately 614 Feet of BERKELEY AVENUE South of Pennsylvania Avenue and 223 Feet of ARMSTRONG AVENUE East of Berkeley Avenue;
 
B.      ACCEPT a DEDICATION DEED From OSF HEALTHCARE SYSTEM for a Strip of Land Along the Relocated BERKELEY AVENUE;
 
C.      ADOPT an ORDINANCE VACATING a Part of ARMSTRONG AVENUE, MISSOURI AVENUE, and the ALLEY Adjacent to Lot 1 in HART PLACE; and

BACKGROUND: The requested right of way dedications and vacations are the result of the following major construction projects completed during the last six years on OSF Healthcare Systems' downtown campus:
 
·      OSF Milestone Project
·      Jump Trading Simulation & Education Center
·      Realignment of Berkeley Avenue between Glen Oak and Pennsylvania Avenues
·      Realignment of Pennsylvania Avenue from Berkeley Avenue to Glen Oak Avenue
·      Realignment of Missouri Avenue between Armstrong Avenue and Pennsylvania Avenue
 
The subject vacations, dedications and permanent easements were previously approved in principle with the City's approval of OSF's Institutional Plan and with the City's approval of a Redevelopment Agreement between the City and OSF Finance Company, LLC on January 10, 2012 (Council Item 12-013). The subject requested actions will formally complete the process.
 
An overview aerial image showing the subject vacation and dedications is included as Exhibit E.
 
Other attachments include the two Vacation Ordinances, the Dedication Deed, and Permanent Easement document and all respective descriptions and plats.
 
FINANCIAL IMPACT:  Relieves the financial burden to the City to maintain, repair and replace the vacated rights-of-way. Note that the 2012 agreement (Council Item 12-013) requires the City to provide snow and ice control on vacated Armstrong and vacated Missouri for a period of five years after the subject vacation.
 
NEIGHBORHOOD CONCERNS:  No objections were heard from utilities regarding these vacations.  An email (attached) from the property owner adjacent to the alley vacation indicates support for the action. All other adjacent properties are owned or controlled by OSF.
      
IMPACT IF APPROVED:  The vacations and dedications will be recorded in accordance with the previous City/OSF agreement and approved Institutional Plan.
 
IMPACT IF DENIED:   The City will not be in accordance with the previous City/OSF agreement.
