ACTION REQUESTED: 

Title

Communication from the City Manager and Corporation Counsel with a Request for the Following:

 

A.                     ADOPT an ORDINANCE Authorizing an Addendum to the MUTUAL AID BOX ALARM SYSTEM (“MABAS”) MASTER AGREEMENT; and

 

B.                     APPROVE the Certification of the Adoption of the Ordinance; and

 

C.                     APPROVE the First Addendum to the MABAS MASTER AGREEMENT.

BACKGROUND: The City of Peoria is one of 1,175 member municipalities or fire districts of Mutual Aid Box Alarm System-Illinois. In October of 2002, the City adopted the ordinance and agreement on the MABAS Master Agreement (File No. 02-711) which is an intergovernmental agreement that provides MABAS the necessary authority and power to oversee and support mutual aid functions throughout most of Illinois and several neighboring states for all applicable emergencies and major disasters.

 

On July 1, 2014, the Executive Board of MABAS issued a memorandum requesting all of its members to execute and return an ordinance approving an addendum to the MABAS Master Agreement. The purpose of the Addendum is to comply with the Federal Emergency Management Agency’s recommendation that addresses the subject of reimbursement terms of any eligible costs. The Addendum to the MABAS Master Agreement is to ensure FEMA reimbursement eligibility under the federal government’s Stafford Act. The Addendum does not establish fees or costs for mutual aid services provided through the MABAS System, but rather it provides a guideline for recouping the costs to communities that provide MABAS mutual aid at events prolonged in nature, defined as 8 hours or more, and the mechanisms to donate the cost of services.

 

In its memorandum, MABAS requested that all three documents be adopted without any modifications by March 31, 2016. MABAS also warned of potential liabilities and consequences for MABAS member agencies that do not adopt the documents.

IMPACT IF APPROVED: The City of Peoria as a member agency of MABAS-Illinois will be in compliance with the FEMA Recovery Policy RP95253.6 Mutual Aid Agreements for Public Assistance and Fire Management Assistance and will not be subject to MABAS’ compliance action.

 

IMPACT IF DENIED:  The City of Peoria as a member agency of MABAS-Illinois will not be in compliance with the FEMA Recovery Policy RP95253.6 Mutual Aid Agreements for Public Assistance and Fire Management Assistance and will be subject to potential liabilities and consequences from MABAS’ compliance action.
