BACKGROUND:  
The Sidewalk Participation and Curb Participation Programs support requests from citizens and businesses that are interested in improving the sidewalk and curb infrastructure adjacent to their properties.  Work under these programs includes replacing eligible, defective sidewalks and curbs and constructing small in-fills in areas that otherwise have sidewalk. These programs include both residential and commercial properties, improve pedestrian safety and accessibility, and can enhance economic development of an area.  Sidewalk Participation has been a popular program in the past with requests typically exceeding resources. The City's share of costs for sidewalk replacement is 80%, and the adjacent property owner pays 20%. The City's share of costs for curb replacement is 50%, and the property owner pays 50%.
 
The Sidewalk In Need of Repair (SINR) Program is another sidewalk replacement program that focuses on a specific area to replace and enhance sidewalks. Public Works staff has been utilizing the recently completed City-wide Sidewalk and ADA Ramp GIS Inventory to assess areas for proposed SINR projects. The GIS inventory gives each property a sidewalk rating.
 
In 2014, the SINR program will enhance sidewalks on the north side of West Ann Street, between Griswold Street and Western Avenue, in Council District 1. The existing Safer Neighborhood Schools Sidewalk Policy, for replacement within a three-block radius of schools, will be applied to this Project, due to its close proximity to Manual High School. Property owners on this project will not be invoiced, with the Safer Schools Policy being used. The Location Map of the SINR 2014 project site is attached.
 
This year, these programs' projects were combined into a single bid letting titled "Sidewalk Programs 2014," and bids were opened on April 2, 2014 with four bids received as follows:

Staff recommends authorization to increase the base bid of the lowest responsible bidder by $16,330.60 to satisfy additional interested participants.
 
C&G Concrete is a local business that has successfully performed work for the City in the past. This contractor also worked on the City's 2011, 2012, and 2013 Sidewalk Participation contracts. The contractor has also successfully performed work on the City's SINR 2013 program.
 
The Good Faith Efforts documentation submitted by C&G Concrete has been reviewed and approved by the Equal Opportunity Manager. The company initially planned to utilize a Women Business Enterprise (WBE) to provide trucking services, but they decided to exceed the WBE participation goal by also awarding another WBE a subcontract to build a timber wall.  The two scopes of work equal 5.62% of the total bid amount.
 
Hermann & Associates, LLC will be performing Construction Engineering services through their Master Engineering Services Agreement with the city, which Council approved on April 24, 2012. Hermann & Associates is a Women Business Enterprise.
 
FINANCIAL IMPACT:  This combined project is funded in the City's Community Investment Plan of the FY 2014-2015 Programs. The total budget for this combination of projects will be utilized as follows:

NEIGHBORHOOD CONCERNS:  Residents request these programs to improve their sidewalk and curb frontage which improves overall neighborhood and walkability.  
      
IMPACT IF APPROVED:  Staff can proceed with issuing construction contracts to initiate the 2014 Community Investment Plan's Sidewalk and Curbs Programs.
 
IMPACT IF DENIED:  The Sidewalk and Curb replacement programs will be delayed in the 2014 CIP.
 
ALTERNATIVES: As Council Directs.
