A.      ADOPT of an ORDINANCE VACATING Approximately 247 Feet of an ALLEY Between WEST MONTANA STREET and SOUTHWEST ADAMS STREET Adjacent to Lots 1, 5 Through 11 and 28 Through 31, in Ulrich Addition to South Peoria, now City of Peoria; and
 
B.      ACCEPT a DEDICATION DEED from HAROLD L. ADAMS to CITY OF PEORIA.

BACKGROUND:  
Overland Engineering, LLC on behalf of the Developer/contract buyer RBA Investments, LLC has requested the Vacation of the Alley described above and on attached Exhibits 1 and 2A. This vacation is necessary to accommodate the development a Dollar General Store at 4015 Adams Street. The Plans for this development are currently being reviewed for approval by the Site Plan Review Board. This vacation is subject to the approval of the site plan by the Community Development Department.
 
As a stipulation to the approval of this alley vacation request, the City of Peoria will require a dedication of a 10' strip of land between the existing, narrow alley right of way and lot 28 (Exhibit 3) described above. Furthermore, the Developer has agreed to pave this unimproved alley right of way to City Standards in order to connect the non-vacated portion of the alley to Montana Street. An existing fire hydrant along Montana Street at the new alley connection will need to be relocated at the Developer's expense.
 
Upon adoption of this Vacation Ordinance, the Developer will be acquiring all property adjacent to the requested alley vacation.  Present owners have signed letters of support for the alley vacation request (Exhibits 2A through 2F).
 
An overview aerial image is included, showing the alley vacation/dedication within and around the boundaries of the proposed Dollar General Store site (Exhibit 4).
 
FINANCIAL IMPACT:  Relieves the financial burden to the City to maintain, repair and replace the vacated rights-of-way.
 
NEIGHBORHOOD CONCERNS:  No objections from the adjacent property owners regarding the rights-of-way vacation.
 
IMPACT IF APPROVED: The vacated rights-of-way will allow the room needed for the development of the Dollar General Store which will include improvements to the City's infrastructure along Montana of new curbs and walks along that frontage of the project.
 
IMPACT IF DENIED:  The City will remain as the owner of the rights-of-way in question and the Dollar General Store will not be developed.
 
ALTERNATIVES: As Council directs.
