Communication from the City Manager and Corporation Counsel with a Request to APPROVE the INTERGOVERNMENTAL AGREEMENT Between DUNLAP CONSOLIDATED UNIT SCHOOLS DISTRICT #323 and the City of Peoria to Provide Mutual Reporting of Investigations, Arrests, and Convictions of Dunlap Students for Certain Criminal Offenses.

BACKGROUND: Section 10-20.14(b) of the Illinois School Code (105 ILCS 5/10-20.14(b)) requires school districts to develop policies and procedures to establish and maintain a reciprocal reporting system between the school and local law enforcement agencies regarding certain criminal offenses committed by students.  Section 22-20 of the School Code also requires that courts and law enforcement agencies inform school districts whenever a student has been detained for proceedings under the Juvenile Court Act for any criminal offense. 

Sections 1-7(A)(8) and 5-905(1)(h) of the Juvenile Court Act (705 ILCS 405/1-7; 705 ILCS 405/5-905) address the information that law enforcement may share with the schools regarding juvenile offenders.  The Intergovernmental Agreement is intended to satisfy both the School Code requirement for reciprocal reporting and the Juvenile Court Act restrictions on release of juvenile arrest and conviction records.

Since part of the City of Peoria is located within the boundaries of the Dunlap School District, Dunlap School District has requested approval of this Intergovernmental Agreement with the City of Peoria so that through the cooperation from the Peoria Police Department, it can comply with the Illinois School Code within the confines of the Juvenile Court Act. The Dunlap District School Board has already approved this Intergovernmental Agreement at its meeting held on August 10, 2016.
