BACKGROUND:  
In 2006, City Council adopted Ordinance No. 16,166 approving the private street of Tuscany Ridge Court, which is located in the Trails Crossing Subdivision.  In 2013, City Council approved the Trails Crossing Phase 3 Subdivision Plat, which modified the design of the private street from a bulb-like to a hammer head style cul-de-sac.  As a result of the Phase 3 subdivision plat, the 2006 Private Street Maintenance Agreement no longer aligns with the design of the private street.  The attached site plan illustrates the difference.  
 
A new Private Street Maintenance Agreement, which describes the cul-de-sac of the Trails Crossing Phase 3 subdivision, has been signed by the developer.

IMPACT IF APPROVED:  The Private Street Maintenance Agreement will replace the agreement approved in 2006 and will accurately align with the design of the private street of the Trails Crossing Phase 3 Subdivision Plat.
 
IMPACT IF DENIED:  The Private Street Maintenance Agreement approved in 2006 will remain in effect and will not align with the design of the private street.
