BACKGROUND:  In 2007, the City Council passed an amendment to Section 3-33 of the City authorizing the retail sale of wine with limited product tasting during the operation of the Riverfront Farmer's Market at the City-owned parking lot on Liberty Park.
 
The proposed amendments to Sections 3-33 and 3-52 will expand the ability to sell wine and craft beer during the farmer's market at the City-owned parking lots on Liberty Park as well as the one next to the River Station. In addition to the retail sale, on-site consumption will be allowed by patrons of the farmer's market in a controlled area on the City-owned property. An adjacent liquor establishment with a beer garden subclass license will be able to sell and serve wine or craft beer to patrons who will be allowed to walk throughout the controlled area with an open container of alcohol during the operation of the farmer's market.
 
The proposed amendments will allow three types of licensees to sell wine and craft beer at the farmer's market on the City-owned parking lots: Class J (winery, craft beer distiller, and brewpub that does not hold a City issued liquor license); adjacent licensee with a beer garden subclass; and craft distiller or a brewpub that holds a City issued liquor license. The annual license fee of $375 for a Class J liquor license will remain unchanged since this license is applicable to a winery, craft beer distiller or a brewpub located outside the City. There will be no additional license fee for adjacent liquor establishment or craft distiller or brewpub with a local liquor license issued by the City.
 
FINANCIAL IMPACT:  There may be additional liquor license fee to the City for any craft beer distiller or a brewpub located outside the City that may desire to sell their beer at the farmer's market at the Riverfront.
 
NEIGHBORHOOD CONCERNS:  None was solicited, but the Riverfront is an area that the City Council desires to be a vibrant area.
      
IMPACT IF APPROVED: Wineries, adjacent liquor establishments, and craft distillers and brew pubs will be allowed to sell wine and craft beer and allow patrons to consume the wine and beer in open containers in the City-owned parking lots during the operation of a farmer's market in the Riverfront area.
 
IMPACT IF DENIED:  The operation of a farmer's market in the Riverfront area will remain limited to the City-owned parking lot on Liberty Park and only for the retail sale of wine.
