Title

Communication from the City Manager and Director of Public Works with a Request for the Following:

 

A.                     APPROVE the LOW BID of ILLINOIS CIVIL CONTRACTORS, INC., in the Amount of $7,854,858.55, for the COMBINED SEWER OVERFLOW CONTROL PROJECT - YEAR 2 (Council District 1); and,

 

B.                     APPROVE and EXECUTE the NOTICE OF INTENT TO AWARD, in the Amount of $7,854,858.55, Contingent upon Award of the IEPA Loan, for the COMBINED SEWER OVERFLOW CONTROL PROJECT - YEAR 2; and,

 

C.                     APPROVE and AUTHORIZE the City Manager to Execute a CONTRACT for the COMBINED SEWER OVERFLOW CONTROL PROJECT - YEAR 2.

 

Body

BACKGROUND:  On December 15, 2020, the City Council approved a Consent Decree with the United States Environmental Protection Agency (USEPA) and the Illinois Environmental Protection Agency (IEPA) to remediate Combined Sewer Overflows (CSOs). This mandate requires CSO reduction projects over an eighteen (18) year time frame, beginning in 2022, to remediate CSOs (ref. item 20-303). The Combined Sewer Overflow Control Project - Year 2 is the second of multiple projects to be constructed to remediate CSOs to meet Consent Decree requirements. 

 

Bids for the Combined Sewer Overflow Control Project - Year 2 were advertised in the Peoria Journal Star and on the City’s website. Bids were opened on January 10, 2023, with two bids received, as follows:

The IEPA State Revolving Fund loan program has different subcontracting and workforce goals than the city. This project selected and included the largest goal. This is why some of the goals on the project are different from the typical city project. The Good Faith Efforts documentation submitted by Illinois Civil Contractors, Inc. was reviewed and accepted by the Chief Diversity and Inclusion Officer, Equal Opportunity Office. The Contractor proposes to utilize 10.1% MBEs for trucking and QA/QC, and 15.3% WBEs for concrete paver installation and landscaping, which meets or exceeds the subcontracting goals of 10% for MBE and 12% for WBE defined for this project. Furthermore, the Contractor will make a good faith effort to reach and exceed the 18% minority utilization and 6.9% female utilization goals in hours worked on the project to comply with Executive Order No. 11246 and 41 CFR 60-4 included in the IEPA State Revolving Fund loan program forms.

 

Illinois Civil Contractors, Inc. achieved 19.16% (18% goal) hours performed by Minority workers and 0.0% (3% goal) of hours performed by Female workers, per eprismsoft.com, on the 2022 North Valley TIF Sidewalk Improvements Contract.

 

Engineering for the Combined Sewer Overflow Control Project - Year 2 was completed by TERRA Engineering, Ltd.

 

The City will use the IEPA State Revolving Fund loan program to fund the project (ref item 21-134). This funding will provide lower interest rates on borrowing than issuing bonds. The current interest rate is 1.24%. 

 

The City will execute the Notice of Intent to Award to Illinois Civil Contractors, Inc., the lowest responsive bidder, noting that the bid will be accepted contingent upon IEPA loan approval.

 

The City will submit Illinois Civil Contractors, Inc.’s bid package and supporting documentation to IEPA for review and approval per the State Revolving Fund loan program process. Upon IEPA loan approval, the City will execute the contract documents including the attached Notice of Award and Agreement and issue the Notice to Proceed. The City Manager was previously authorized to sign and submit loan application forms, tax compliance certificate and agreement, and supporting documents for the IEPA loan program (ref item 21-134).

 

 

FINANCIAL IMPACT:  This project is funded in the Combined Sewer Overflow Reduction Year 2 Project in the CIP budget using the State revolving funds. Project number W2301.

 

NEIGHBORHOOD CONCERNS: The CSO control program projects will improve our neighborhoods with the addition of green infrastructure. The CSO control program will also reduce the number of CSOs to the Illinois River.

                     

IMPACT IF APPROVED: The City will make progress towards reducing the number and volume of CSOs and stay on schedule for implementing the CSO control program as required by the City’s Consent Decree.  

 

IMPACT IF DENIED: No change will occur in the number or volume of CSOs and the ability of the City to meet required CSO control levels per the schedule in the City’s Consent Decree will be impacted.
