A.                     ADOPT an ORDINANCE Amending the City of Peoria 2016/2017 BIENNIAL BUDGET Relating to the Capital Fund Budget for Fiscal Year 2016 For the Construction of a Permeable Paver Parking Lot at 214 PECAN and the Corresponding Contribution from the Developer in the Amount of $36,400.00.

MOTION ON THE FLOOR:  To ADOPT an ORDINANCE amending the City of Peoria 2016/2017 Biennial Budget relating to the capital fund budget for Fiscal Year 2016 for the construction of a permeable paver parking lot at 214 Pecan and the corresponding contribution from the developer in the amount of $36,400.00.

BACKGROUND: Additional information follows, in bolded font, pursuant to discussions during the City Council meeting of September 27, 2016:

 

 On May 24, 2016, the City Council approved a construction contract for the Combined Sewer Overflow (CSO) Pilot Project on Adams Street between Pecan and Persimmon Streets (Item 16-177). This is the first Complete, Green Street project in a future decades-long CSO program. A primary goal of this project is to infiltrate (soak) stormwater into the ground before the water can flow into the combined sewers, which are overwhelmed during significant rains.

At 214 Pecan Street, WD Community Investment, LLC is renovating 214 Pecan Street, a 3-story building in the Warehouse District, as a mixed-use project consisting of residential and commercial spaces.  One Fire Media Group, Inc. is a future commercial tenant of the building.


The 214 Pecan project and the Adams Street CSO project are adjacent to one another. In discussions among The Kim Group, River City Construction, Farnsworth Group (members of the 214 Pecan project team) and the Public Works Adams Street Pilot Project team, it was determined even more stormwater could be kept out of the combined sewers through combining efforts on the projects.  Instead of constructing a concrete parking lot on the 214 Pecan project as planned, a permeable paver parking lot can be constructed by the City’s Adams Street contractor. This permeable paver parking lot will soak up (infiltrate) stormwater, before overflowing into Pecan Street and into the combined sewers.

A permeable paver parking lot constructed on the 214 Pecan site will keep an additional 20,000 gallons of stormwater out of the combined sewer system in the 10-year design storm model. The elimination of the concrete parking lot on the 214 Pecan site will lower the 214 Pecan project cost by $36,400. The developer is willing to contribute this amount to the City’s CSO project. The City will then build the permeable paver parking lot.


The developer will own and maintain the pervious parking lot, after construction.

The entire CSO program is estimated to cost $200-250 million for control of 37 million gallons of stormwater in the 10-year design storm-an average of $5.40-$6.75/gallon. Control of 20,000 gallons of the $100,000 permeable paver parking lot compares favorably at a per gallon cost of about $5.00.

 

Council members are concerned with setting a precedent by financially assisting with private property stormwater improvements and potentially granting stormwater utility credits to the same property in the future. At a future date, staff will recommend a Stormwater Utility Credit Policy for the City Council’s consideration, along with a recommendation of many other aspects of a Stormwater Utility.

 

For the 214 Pecan Street property under consideration in this item, the property owners agree to forgo all future stormwater utility credits for the parking lot portion of this property for a period of ten years after the date of this item’s approval.

If approved, staff plans to use this opportunity to measure the total effect of green infrastructure installed on the right of way and on adjacent property on flow reduction in the combined sewer. Because the Adams Street project is a ‘pilot project’ we have had monitoring devices in the adjacent sewers for about one year. We will keep the monitors in place for approximately one more year to compare before and after data.

FINANCIAL IMPACT:  The developer will contribute $36,400 to the City project toward construction of a permeable paver parking lot on the 214 Pecan Street site. The City’s financial participation is estimated to be up to a maximum contribution of $63,600, for a maximum total cost of $100,000 for the parking lot. The City’s share of up to $63,600 can be accommodated in the previously-awarded construction contract for the Adams Street project (Item 16-177).

 

NEIGHBORHOOD CONCERNS:  Renovations in the Warehouse District and reductions in the City’s Combined Sewer Overflow issue are widely held community goals.

                     

IMPACT IF APPROVED: Public Works’ staff and contractor will partner with the 214 Pecan project to construct a pervious paver parking lot adjacent to the City’s Adams Street CSO Pilot Project.

 

IMPACT IF DENIED:  The 214 Pecan project will construct a concrete parking lot as planned.

 

ALTERNATIVES:  None.
