Communication from the City Manager and Director of Public Works with a Request for the Following:

 

A.                     APPROVE a CONTRACT AMENDMENT, Budget Amendment #1, to the GLEN AND SHERIDAN ROAD CULVERT PROJECT, in the Amount of $60,796.80, for a Total Budgeted Amount of $479,789.00 (Council District 3)

 

B.                     ADOPT an ORDINANCE Amending the City of Peoria 2021 REVISED ANNUAL BUDGET Relating to Stormwater Utility Enterprise Fund to Additional Provide Funding for the GLEN AND SHERIDAN ROAD CULVERT PROJECT in the Amount of $60,796.80 and Recognize the Receipt of the Property Owners Share in the Amount of $34,259.16.

BACKGROUND:  After further communication with the owner, the revisions are appropriate to move forward to make payment to the contractor and complete the project. Red Carpet Properties, Inc. owns the property identified as 711 W. Glen Avenue (the “Property”) within the City of Peoria. Red Carpet Properties, Inc. The Property has a large stormwater drainage improvement underneath private property but connecting public infrastructure.  The stormwater infrastructure needed to be replaced and it was in the best interests of the City to have the infrastructure placed both in the public right of way and in a public easement. Council approved the agreement defining the scope and responsibilities of the parties jointly undertaking the construction of new stormwater drainage improvements on the Property in Council Item 20-068.

 

The Glen Ave. and Sheridan Rd Culvert Project was advertised, and bids were opened on July 24, 2020 and Council awarded August 11, 2020.

Due the agreement, some of the items are City only items, some are property owner only items, and some are split 50%-50% between the City and the property owner. The City will hold the contract, will pay the pay estimates, and will invoice the Property Owner for their share of the cost. The final construction cost for the City is $249,641.29.

 

The additional expenses on the project were due to utility conflicts under the Glen Avenue and unknown conditions on the property. The utility conflicts (Ameren Gas and Illinois American Water) would have caused the project to be delayed several months. Delaying the contract would cause the property owner further burden by extending their forced closure and could have the City to potentially violate the above-mentioned agreement. The unknown conditions on the property will be reimbursed by the property owner due to the location of the obstructions.

J.C. Dillon is a local business that has successfully performed work for the City in the past. The 2019 Annual Drainage Repair Contract with 2020 extension is a project with similar work. On the Annual Drainage Repair Contract, through pay period ending July 1, 2020, the company utilized 22.6% minority (18% goal) and 0.25% female (3% goal) workforce. No subcontractors were reported.

 

The Good Faith Efforts documentation submitted by J.C. Dillon were reviewed and approved by the Chief Diversity & Inclusion Officer. The contractor will utilize the following subcontractors: 7.6% MBE for trucking and 5.7% MBE for concrete pipe material for a total 13.3% MBE (10% goal) and 0% WBE’s (5% goal). The contractor will make a good faith effort to reach the 18% minority workforce utilization and 3% female workforce utilization on the project.

 

FINANCIAL IMPACT:  The project will be funded with stormwater utility funds. The City’s cost is $249,641.29. The property owner’s cost is $230,147.71.

 

NEIGHBORHOOD CONCERNS:  This project will construct new storm sewer in the right of way or permanent easements that will carry the flow of Dry Run creek.

                    

IMPACT IF APPROVED: The project can be completed, and the contractor paid.

 

IMPACT IF DENIED: The City will not be eligible to pay the prime contractor.
