Communication from the City Manager and the Community Development Director with a Request to Concur with the Planning & Zoning Commission and Staff to ADOPT an ORDINANCE Amending an Existing SPECIAL USE Ordinance No. 13,450 as amended, in a Class C-2 (Large Scale Commercial) District for a Shopping Center to Add a Restaurant with a Drive-Thru for the Property Identified as Parcel Identification Nos. 14-29-327-003, 14-29-327-021, 14-29-327-025, and 14-29-327-026, with an Address of 3425 - 3525 N UNIVERSITY STREET and Commonly Known as UNIVERSITY PLAZA SHOPPING CENTER.  (Council District 2)

BACKGROUND: Petitioner Larea Tucker of Vertical Construction Management is proposing a 2,500 sq. ft. Hardee’s restaurant constructed in the existing parking lot area along the frontage of University St. 

 

The petitioner’s proposal includes a freestanding sign located 91 feet north of the existing multi-tenant shopping center sign.  The proposed sign does not meet the minimum required 150 feet of separation from the existing multi-tenant sign, therefore a waiver is requested.

 

The Planning & Zoning Commission found that the request met the Findings of Fact requirements and VOTED 6 TO 0 TO APPROVE the request, not including the requested sign waiver, and subject to the following conditions:

 

1)                     The City’s 2016 University Avenue Reconstruction will include installation of property line sidewalks along the property frontage. In exchange for new sidewalks, the property owner will be asked to donate permanent or temporary easements. Plans should indicate that contractor should coordinate sidewalk construction abutting ROW sidewalk with Public Works Department.

IMPACT IF APPROVED:  The Special Use for the University Plaza Shopping Center will be amended to allow a Hardee’s restaurant building to be constructed along the frontage of University Street.

 

IMPACT IF DENIED:   The special use for the shopping center will not be amended and the restaurant building will not be constructed.
