Communication from the City Manager and Community Development Director with a Request to APPROVE an INTERGOVERNMENTAL AGREEMENT with the PLEASURE DRIVEWAY AND PARK DISTRICT OF PEORIA Related to Development in DONOVAN PARK located at 5805 N KNOXVILLE AVENUE.

BACKGROUND:  The Peoria Park District is pursuing an opportunity to repurpose the Donovan Park Clubhouse building as a restaurant. 

 

On Wednesday, November 28, 2017, the Peoria Park District hosted a public meeting in the clubhouse at Donovan Park to present the proposed restaurant concept and listen to input from the public.  Approximately eighty (80) people attended the meeting.

 

The proposal is to convert the existing clubhouse building into a restaurant.  There would be significant interior work to the building, but the footprint of the structure would only have a slight change.  The restaurant would lease the land and building from the Park District and would pay property taxes and all other taxes associated with a restaurant.

 

The Park District is subject to City ordinance regulations.  The Donovan Park property is zoned R-2 (Single-Family Residential), and therefore the use of a restaurant is being addressed through an intergovernmental agreement, as opposed to rezoning the entire 135 acre parcel, or subdividing it and creating a situation of ‘spot zoning’. 

 

The proposed inter-governmental agreement includes the following elements related to the proposed restaurant development and the overall enhancement to Donovan Park:

v                     The Park District may lease the clubhouse to an entity that will establish a restaurant.

v                     Renovation of the existing clubhouse building is permitted, per applicable building code requirements; however, any additions to the building would require the appropriate zoning review. 

v                     The Peoria Park District and the lessee of the clubhouse may place one freestanding sign along the Knoxville Avenue frontage.  The sign will be a combined sign for the Park District and the restaurant, and may not exceed 40 square feet in area and 6 feet in height. The sign must be setback a minimum of 10 feet from the front property line along Knoxville Avenue.  In addition, the sign must be placed 150 feet from any existing signs on the Donovan Park property. The Park District is responsible for any permits required by other governmental authorities.

v                     An additional digital sign may be placed along Knoxville Avenue, south of the Donovan Park entrance, a minimum of 150 feet from the entrance sign. The sign may not exceed 30 square feet in area and 6 feet in height, with a maximum of 20 square feet of the sign area being digital.  The sign must be set back a minimum of 10 feet from the front property line along Knoxville Avenue. 

 

Please note that the inter-governmental agreement does not provide for approval of liquor sales. A liquor license will be required and will be processed in the same manner as any other restaurant liquor license.

IMPACT IF APPROVED: The clubhouse will be repurposed as a restaurant, to complement the Park, and two signs will be added along Knoxville Avenue.

 

IMPACT IF DENIED:  The clubhouse would not be repurposed as a restaurant and no signage would be added to the site.
