Communication from the City Manager and the Community Development Director with a Request to ADOPT an ORDINANCE Amending Chapter 13 of the CODE of the City of Peoria Pertaining to ENVIRONMENTAL VIOLATION FINES and ADMINISTRATIVE FEE for WORK ORDERS.

 

Body

BACKGROUND:  During the City Council meeting on January 26th concerns were raised about the ordinance language change related to abandoned unsafe refrigerators.  Staff is still in the process of researching liability issues and safety concerns.  Staff will bring back that section of the ordinance for discussion at the February 23rd City Council meeting.  As no additional concerns were raised regarding the other language changes, staff would recommend approval of the remaining items.

 

During the 2016/2017 budget process, an increased fine and fee structure for environmental citations and work orders was approved by the City Council. 

 

The initial ticket for environmental code violations will remain at $50.  The second ticket will be increased to $200, and the third (and subsequent tickets) will be increased to $500.  Escalating citations will be based on the previous twenty-four months.

 

The administrative fee attached to a work order issued to a City contractor for mowing grass and removing debris/litter has previously been $75.  This fee will be increased to $125.

 

 

FINANCIAL IMPACT:  Fine and fee increases were approved as part of the 2016/2017 budget process.

 

NEIGHBORHOOD CONCERNS:  Increasing the fine and fee structure holds violators more accountable for their actions.  In addition, changing the time frame refrigerators can remain on the exterior of a property increases public safety.

                     

IMPACT IF APPROVED: Fine and fee structure will be increased.

 

IMPACT IF DENIED:  The 2016 and 2017 budget would not be balanced.
