ACTION REQUESTED: 

Title

Communication from the City Manager and Director of Community Development with a Recommendation from the Planning & Zoning Commission and Staff to ADOPT the Following:

 

A.                     An ORDINANCE Amending Appendix B, the Zoning Ordinance, Relating to MOBILE FOOD VEHICLES AND CARTS, and

 

B.                     An ORDINANCE Amending Appendix C, the Land Development Code, Relating to MOBILE FOOD VEHICLES AND CARTS.

 

Body

BACKGROUND: 

Staff is continually working to simplify zoning regulations, encourage development, and provide opportunities for economic growth.  The proposed text amendment is intended to allow mobile food vehicles and carts as a temporary use in non-residential zoning districts with the following performance standards:

 

                     No limit on the frequency or duration

                     No site plan or zoning certificate required

                     Vehicle or cart must be placed on a paved surface

                     Seating may be provided during hours of operation

 

The proposed definition of Mobile Food Vehicle is the same definition as recently approved for food vehicles in the right-of-way.

 

Note that the proposed ordinances also include language for Roadside Stand, Roadside Produce Stand and Home-Produces Fruits and Vegetable Sales.  These uses were approved by City Council on July 8, 2014.  Unfortunately, Municode, the company which codifies our codes, did not receive the complete ordinance.  As a result, a portion of the approved text amendment was omitted from codification.  The current text amendment includes the omitted language to correct this mistake.

NEIGHBORHOOD CONCERNS (at the Planning & Zoning Commission Meeting):  None

 

PLANNING & ZONING COMMISSION ACTION:  The Planning & Zoning Commission found that the request met the Findings of Fact and voted 6 to 0 to APPROVE.

                     

IMPACT IF APPROVED:  Mobile food trucks and carts will be permitted to operate as a temporary use in non-residential zoning districts.

 

IMPACT IF DENIED:  Zoning regulations will remain unchanged, which prohibit mobile food trucks and carts on private property.
