Communication from the City Manager and Director of Public Works with a Request to APPROVE the Low BID from KRUMHOLZ BROTHERS LANDSCAPING, INC., in the Amount of $136,190.00, and Award a CONTRACT for the SPRINGDALE CREEK STREAMBANK STABILIZATION, with an Additional Authorization of $13,619.00 (10%) for Contingencies, for a Total Amount of $149,809.00. (Council District 3)

BACKGROUND:  On December 15, 2020, the City Council approved a Consent Decree with the United States Environmental Protection Agency (USEPA) and the Illinois Environmental Protection Agency (IEPA) to remediate Combined Sewer Overflows (CSOs) (ref. item 20-303). This mandate requires that a state supplemental environmental project (SEP) be completed.  Per the Consent Decree, the SEP shall consist of stream and gully restoration within Turkey Creek and Springdale Cemetery to reduce stream erosion.

 

This project was undertaken in connection with the settlement of an enforcement action taken by the Illinois Attorney General and the Illinois Environmental Protection Agency for alleged violations of the Illinois Environmental Protection Act and regulations promulgated thereunder.

 

Bids for the Springdale Creek Streambank Stabilization project were advertised in the Peoria Journal Star and on the City’s website. Public Works received bids on May 3, 2022, with three bidders submitting.

The Engineer’s estimate for the project is                      $167,015.50

 

Staff recommends increasing the low bidder’s contract to $149,809.00 to accommodate a 10% contingency.

 

Krumholz Brothers Landscaping, Inc. (Krumholz) is a local business that has been pre-qualified by IDOT for the type of work to be completed for the Springdale Creek Streambank Stabilization project.  Krumholz also builds several of the private property drainage assistance grant program projects each year.  Krumholz Brothers Landscaping, Inc. has an active apprenticeship program registered with the US Department of Labor (registration #IL006103685), in accordance with the City’s responsible bidder for public works construction contracts ordinance (Ord. No. 16918).

 

The subcontractor utilization statement submitted by prime contractor Krumholz Brothers Landscaping, Inc. indicates that the company will not be utilizing any subcontractors on this project and the company submitted a Minority/Women Business Enterprise (M/WBE) Participation Waiver Request.  Documentation is hereby reviewed and approved by the Chief Diversity and Inclusion Officer, Equal Opportunity Office.  The company’s Minority/Women Business Enterprise (M/WBE) Participation Waiver Request was granted because the company will be self-performing all of the work.  Krumholz Brothers Landscaping, Inc. last completed a project for the City in 2008 and recent project minority and female workforce participation rates aren’t available.  Krumholz Brothers Landscaping, Inc. is committed to reaching the 18% minority and 3% female workforce participation goals.

 

Engineering for this project was completed by Farnsworth Group. 

 

 

FINANCIAL IMPACT:  The Project will be funded through Project #O2201 from the Stormwater Utility identified in the Community Investment Plan.

 

NEIGHBORHOOD CONCERNS:  The Springdale Creek Streambank Stabilization project will reduce Turkey Creek erosion and help maintain the aesthetics of Springdale Cemetery.  The project will also ultimately reduce sedimentation into the Illinois River, which will improve water quality, navigation, and habitat.

                     

IMPACT IF APPROVED: The City will stay on schedule for implementing the SEP as required by the City’s Consent Decree.  

 

IMPACT IF DENIED: The City will not meet the Consent Decree requirements.
