Communication from the City Manager and Corporation Counsel with a Request to ADOPT an ORDINANCE Supplementing the City of Peoria’s SEXUAL HARASSMENT POLICY.

BACKGROUND: Public Act 100-0554 (the Act) amended the State Officials and Employees Ethics Act, including Section 70-5, which pertains to government entities. The Act mandated all governmental units adopt an ordinance adopting a policy prohibiting sexual harassment. The City has an existing policy prohibiting all forms of harassment, including sexual harassment. The existing policy was reviewed for compliance and the attached policy reflects recommended changes to comply with the new mandates.
Specifically, the new policy includes additional examples of conduct that constitutes sexual harassment, including conduct or contact that occurs via electronic means. The new policy includes a prohibition on retaliation for reporting sexual harassment allegations, including availability of whistleblower protections under the State Officials and Employees Ethics Act, the Whistleblower Act, and the Illinois Human Rights Act; and the consequences of a violation of the prohibition on sexual harassment and the consequences for knowingly making a false report.
