ACTION REQUESTED: 

Title

Communication from the City Manager and the Director of Public Works with a Request to ADOPT an ORDINANCE Vacating 6,076 Square Feet (0.14 Acre) of BROMPTON COURT, from ALLEN ROAD to BROMPTON COURT, in ROLLINGBROOK SUBDIVISION - SECTION THREE, in the City of Peoria, Illinois.  (Council District 5)

 

Body

BACKGROUND:  The subject portion of the Brompton Court right-of-way (ROW) provided access to Brompton Court properties until the Illinois Department of Transportation (IDOT) improved Allen Road between 2013 and 2016. The Brompton Court properties are now accessed from the new pavement constructed as part of the IDOT improvement. (See attached location map.)

The subject ROW was always intended as an interim access to Brompton Court properties until the IDOT improvement was completed.  The following comment is noted on the 2006 subdivision plat:

“The east-west portion of Brompton Court is designed as a temporary access from Allen Road. According to the current IDOT design, this access may become obsolete because of a road re-alignment. After an alternative access onto this property from the south is available, said portion of Brompton Court can be platted as Lot 91B. Lot 91A will remain undeveloped until adjoining Lot 91B is platted.”

The developer has now requested the vacation of the subject ROW, so that the two new duplex lots are available. The developer is currently working with the Community Development Department to complete the re-subdivision of the duplex lots.

As the rights-of-way described are no longer of value to the public, city staff has no objection to this vacation.  See attached Vacation Ordinance and Vacation Plat.

 

FINANCIAL IMPACT:  Vacating the subject ROW will create lots for two, new duplex residences, which will increase property tax revenue.

 

NEIGHBORHOOD CONCERNS:  No known concerns.

                     

IMPACT IF APPROVED: The City will vacate the subject ROW per the intent of the original subdivision. Two new duplex lots will be created when the re-subdivision process is completed.

 

IMPACT IF DENIED:  City will continue to maintain this un-useable ROW, and no new development will occur.
