Communication from the City Manager and Director of Community Development with a Request to Concur with the Recommendation from the Planning and Zoning Commission and Staff to ADOPT an ORDINANCE Approving a SPECIAL USE in a Class C-1 (General Commercial) District for ADULT USE CANNABIS DISPENSARY for the Property Located at 2301 WEST GLEN AVENUE (Parcel Identification No. 14-19-255-012), Peoria, Illinois (Council District 4).

BACKGROUND: The Petitioner, Mark D. Walton, on behalf of Ron DiGiacomo of Trinity M.M.J., LLC is requesting to obtain a Special Use in Class C-1 (General Commercial) District for Adult Use Cannabis Dispensary. The dispensary will be located in building previously used as a retail establishment.
The Planning and Zoning Commission found the request met the Findings of Fact and voted 7 - 0 to approve the proposed use with the following waivers and conditions:
Waivers
1. Waivers requested for parking lot landscaping points, and parking lot perimeter requirements.
2. Waiver for existing conditions for setback along Northland, Glen and Renwood.
Conditions
1. Meet drainage Ordinance requirements.
2. Correct right-of-way encroachments.
3. Provide required accessible space signage.
4. Provide sidewalks on all three frontages, and corresponding right-of-way dedications as needed.
5. Provide a pedestrian and bicycle pathway to the main entrance.
6. Add three shade trees along Northland Ave.
7. Correct drive approach along Northland so that it no longer encroaches on the adjacent property.
FINANCIAL IMPACT: N/A
NEIGHBORHOOD CONCERNS: Two residents expressed concerns about proximity to schools, if in the case of retail theft would thieves run through the neighborhood, use of security guards and cameras, stated they believed this was not a family-friendly business, that recreational users are very different from medical users; and that the use is better suited to an industrial location. At the hearing in response to questions asked by the residents, the petitioner stated there will be a security guard, there will be cameras; and there will not be a drive through, as that is not permitted by the State of Illinois.
IMPACT IF APPROVED: A new cannabis dispensary may be established at the subject location. Specific site improvements will accompany the use.
IMPACT IF DENIED: The site will remain as is, with a vacant retail building.
