BACKGROUND: The City of Peoria's combined sewer overflows (CSO's) have been regulated by USEPA and IEPA for over 25 years. This regulation is through a permit in the National Pollutant Discharge Elimination System (NPDES). The permit is renewable every five years. When the City of Peoria's permit was issued in June, 2006, the City was required to develop a Long Term Control Plan (LTCP) to address the impact of CSO's.
 
Since 2006, the City has continued the negotiations with the United States Environmental Protection Agency (USEPA) and Department of Justice (DOJ) including review of technical documents submitted by the USEPA for a proposed LTCP. The reviews as well as responses of these technical documents have required the expertise of skilled experts in the field, consultants comprising of the AMEC team.
 
In 2010, the City was presented with a LTCP with a "gray" (tanks and tunnels) solution that posed potential liability risk, undue financial burden, and unreasonable disruption to the City and its infrastructure. Recently, the City was successful in investigating a solution that incorporates green infrastructure.
 
During the remainder of 2014 and during early 2015, LTCP project focus will be on further refining the green infrastructure solution and financial analyses and renewing the public involvement efforts. One of the first efforts will be to install monitors in the combined sewer collection system to quantify the needs and opportunities for effective green infrastructure. As the parties are nearing the final stages of negotiating the terms of an agreed LTCP, the City continues to need expertise of the outside consultants to conduct studies and determine the steps needed for the LTCP.
 
The attached Scope of Work indicates the detailed task descriptions and man-hour efforts. The AMEC team includes the following sub-consultants:  Symbiont; ELM, LLC; Maurer-Stutz Engineering; CH2M Hill; and John Todd Ecological, LLC. The AMEC team was initially hired in February, 2007, after a selection process.  After an additional selection process, their contract was expanded in June, 2007.

Proposed Task Order #7, including the Scope of Work, is attached to this communication.
 
FINANCIAL IMPACT:  Sufficient Funds are available in the 2014 and (planned) 2015 Community Investment Plan for project S12003, "Combined Sewer Overflow Long Term Control Plan" to pay for Amendment  #6 of the subject agreement.
 
NEIGHBORHOOD CONCERNS:  A Clean River Committee made up of citizens and interested organizations, provided input during the initial development of the plan from 2007 through 2010. The subject scope of services includes renewing the public participation efforts for this project. An affordable, flexible plan that incorporates green infrastructure and complements redevelopment will benefit neighborhoods and businesses.
 
IMPACT IF APPROVED:  The City will move toward compliance with Clean Water Act CSO NPDES permit requirements.
 
IMPACT IF DENIED:   The City could be subject to enforcement action by the USEPA for noncompliance of CSO NPDES permit requirements.
