B.                     ADOPT an ORDINANCE Annexing Territory for the Property Generally Located North of Wood Sage Road, South and West of IL Route 91, along the East Side of Orange Prairie Road Identified as Part of Parcel Identification No. 08-35-100-034, with a Temporary Address of 9800 N ORANGE PRAIRIE RD, PEORIA, IL; and

BACKGROUND:

 

Petitioner, Jason Payne of Big Shots Golf, LLC, is requesting the following:

1)                     Annex 20.5 acres located along the east side of Orange Prairie Road extended.  The property is contiguous to Peoria’s corporate boundary along its southern property line.

2)                     Rezone the property from Class R-3 (Single Family Residential) to Class C-1 (General Commercial) upon annexation.

3)                     Special Use for an Active Park for the northern 10.6 acres of the subject parcel to be developed as an indoor/outdoor golfing facility

 

The request for the Special Use includes the following waivers:

1)                     Section 9.6.d: Increase the maximum building height from 35 feet to 47 feet.

2)                     Section 3.2.f: Increase the fence/netting height from 6 feet to 110 feet for the synthetic target greens only as shown on the site plan.

 

The Planning & Zoning Commission found that the request met the Findings of Fact and voted 6 to 0 TO APPROVE subject to the following conditions:

1)                     Revise the preliminary/final plat to subdivide the parcel into two lots delineating the special use/development area vs non-developed area.

2)                     Compliance with federal, state and local regulations for wetland mitigation, if any.

3)                     Approval from Public Works Dept of the proposed median break on Orange Prairie Road, which may require northbound and/or southbound auxiliary turn lanes.

 

Note:

Following the Planning & Zoning Commission meeting, the petitioner agreed to additional language within the annexation agreement addressing the future development of the southern half, comprising 10 acres, of the property.  This language, found in paragraph 3B of the agreement, allows for administrative review of building design and materials.  Appeals of the administrative decision may be made to City Council.

PLANNING & ZONING COMMISSION ACTION:  The Planning & Zoning Commission found that the request met the Findings of Fact and voted 6 to 0 TO APPROVE the annexation agreement, rezoning, and special use, including the requested waivers.

 

IMPACT IF APPROVED:  The 20.5 acre subject property will be annexed, rezoned to C-1 General Commercial, and developed with a golfing facility on the northern 10.5 acres. 

 

IMPACT IF DENIED:   The subject property will not be annexed to the City, rezoned or developed as a golfing facility.
