Communication from the City Manager and the Community Development Director with a Recommendation from the Planning and Zoning Commission and Staff for the Following:
 
A.      ADOPT an ORDINANCE Amending APPENDIX B, the Zoning Ordinance, of the CODE of the City of Peoria, with Respect to FUNERAL HOMES in Residentially Zoned Districts, and
 
B.      ADOPT an ORDINANCE Amending APPENDIX C, the Land Development Code, of the CODE of the City of Peoria, with Respect to FUNERAL HOMES in Residentially Zoned Districts.
 
Body
BACKGROUND:  
Funeral Homes are currently allowed as a permitted use in the C-N (Neighborhood Commercial), C-G (General Commercial), B-1 (Central Business), C-1 (General Commercial), and C-2 (Large Scale Commercial) Districts.  
 
A location in close proximity to residential districts is often appealing to funeral home operators.  Some of the uses currently allowed as Special Uses in residential districts include cemeteries, churches, convents, elderly housing and public and private schools. Staff feels that the intensity of the use of a funeral home is comparable to the uses currently allowed as specials uses in residential districts within the Land Development Code and Zoning Ordinance.  
 
As a result, the Site Plan Review and the Zoning Commission recommend that the Zoning Ordinance and Land Development Code be amended to allow funeral homes as Special Uses in residential districts.  The Special Use process will provide an opportunity to review proposed sites to ensure that the proposed site is appropriate and adequate improvements are in place to provide necessary buffers from surrounding residential dwellings.  
 
ZONING COMMISSION ACTION:
The Planning and Zoning Commission found that the request met the Findings of Fact requirements and VOTED 6 TO 0 TO APPROVE.
