BACKGROUND:  
Council approved the original reprogramming of funds for the Mount Hawley Road sidewalk project by Special Assessment as Item #15-082 on March 10, 2015. The Board of Local Improvements, on February 17, 2015, accepted the 100% majority petition requesting the improvement of the east side of Mt. Hawley Road, from East High Point Road to North Fox Point Drive.  City staff, its consultant, the Hawley Hills Homeowners Association, and the four residents to be assessed have met several times. The four property owners involved in the project have signed a Consent to Order of Default and Confirmation for acceptance of the assessments. This allows the expedition of the Special Assessment process by foregoing claims in the Circuit Court in this matter.
 
The improvement shall consist of the construction of a city standard sidewalk along the easterly side of North Mount Hawley Road, between Fox Point Drive and High Point Road. The sidewalk project consists of installing a five foot (5') wide Portland Cement Concrete sidewalk, as well as all necessary driveway adjustments, culvert replacements, shrub removal, tree removal and appurtenances.
 
NET LENGTH OF IMPROVEMENT: 740 feet (0.39 Mile)
 
ASSESSMENT:  Assessment will be determined by the Superintendent of Special Assessments for the City of Peoria, subsequent to the adoption of the Ordinance and subject to possible later corrections. Tentative Assessment Rates, as determined by the Board of Local Improvements, are as follows:
 
Approximate Assessment Rate is:  $12.99 per front foot
      Assessed Against the Properties      =       $    7,820.00  =  7.15%
      Assessed Against the Public             =      $101,547.01 = 92.85%
            Total Assessment            =      $109,367.01 = 100.0%
FINANCIAL IMPACT:  The total cost of the improvement is $109,367.01. This project is funded in Projects A15001 and PB1505 for the Mount Hawley Road Sidewalk Improvement Project by Special Assessment.  
 
NEIGHBORHOOD CONCERNS:  Staff has met and spoken with the nearby Homeowners Association and the 4 affected property owners. All stakeholders are currently in final agreement to install the sidewalk via use of the Special Assessment Program and have signed Consents to Default. This sidewalk installation would extend the reach of the sidewalk on the east side of Mount Hawley Road to the expansive neighborhood east of Mount Hawley Road, accessed from Fox Point Drive, and connect the sidewalk system near Kellar School.
      
IMPACT IF APPROVED: Staff could implement the Project using the Special Assessment Process. The next steps include filing the attached Ordinance and Consents to Default and Confirmation with the Circuit Court and advertising the project for bid.       
 
IMPACT IF DENIED:  Staff will not be able to honor a majority petition, honor the Consent to Default by all owners, or issue a contract to construct the sidewalk with the Special Assessment program.
 
ALTERNATIVES:  Provide further direction to staff.
