ACTION REQUESTED:

Title

Communication from the Mayor and Corporation Counsel with a Request to APPROVE the DECLARATION OF LOCAL STATE OF EMERGENCY.

Body

BACKGROUND:  Following the death of George Floyd on May 25, 2020 in Minneapolis, Minnesota, the City of Peoria experienced events that required intervention to restore order, ensure the safety of protestors and the public, protect property and provide additional resources to support our local businesses.  There have been instances of unlawful activity resulting in injuries to first responders, significant property damage and an escalation of violent events.  On Wednesday, June 3, 2020, Governor J.B. Pritzker added Peoria County to an existing disaster proclamation, citing that within Peoria County there was (1) a threat for looting or destruction through planned protest (2) that Peoria County was home to critical infrastructure or (3) was a location where the state had received requests for state assistance or resources. On June 4, 2020, the Mayor issued a Declaration of Local State of Emergency invoking the powers granted pursuant to the Illinois Municipal Code, the Illinois Emergency Management Act and Ordinance Section 7-35.2 to deal with the civil unrest.

The Mayor’s Declaration of Emergency must be renewed after each regularly or special scheduled council meeting.  The Mayor intends to renew the Declaration of Emergency to include the following:

•                     Implement the Emergency Operations Plan, as necessary.

•                     Coordinate with the National Guard, personnel from the Illinois State Police, the Illinois Emergency Management Agency and other mutual aid networks as needed.

•                     Coordinate with the local or state Emergency Operations Center, as necessary.

•                     Adjust or alter staffing schedules and assignments, as needed.

•                     Enter into contracts for the employment of temporary workers, the rental of equipment, the purchase of supplies and materials and the appropriate expenditures and disposition of public funds and property as necessary.

FINANCIAL IMPACT:  To be determined.  Any and all FEMA reimbursable costs are being tracked and will be submitted with a request for reimbursement.

NEIGHBORHOOD CONCERNS:  None.

IMPACT IF APPROVED: The Mayor’s Declaration of Emergency will continue to allow changes as noted above.

IMPACT IF DENIED:  The changes noted above could still be implemented by the Mayor over the Council’s objection.
