Communication from Councilman Zach Oyler with a Request to DIRECT STAFF to Place a 90-DAY MORATORIUM on Enforcement Action Related to Operating a SHORT-TERM RENTAL Without a Special Use, to Allow for Those Currently Operating to Come into Compliance with City of Peoria Ordinances, and Void Previously Issued Citations for Failure to Obtain a Special Use Prior to Operating a Short-Term Rental.

BACKGROUND: At the October 26th, 2021 Peoria City Council meeting, Councilman Oyler requested that an agenda item be brought forward to the next City Council meeting requesting staff to place a 90-day moratorium on enforcement action related to operating a short-term rental unit without a special use to allow those who are current operating to go through the process to come into compliance with the required ordinances.
In addition, it was requested that all citations previously issued for this violation be voided.

Please note that the above addresses are suspected of operating a short-term rental without a special use. The property owners have not had a court date yet to determine if the violation is valid.
Staff issued citations under: Sec. 27-155. - Penalties. Any person found guilty of violating, disobeying, omitting, neglecting or refusing to comply with, or resisting or opposing the enforcement of any of the provisions of this article, except when otherwise specifically provided, upon conviction thereof, shall be punished by a fine of not less than $200.00 nor more than $300.00 for the first offense and not less than $300.00 nor more than as provided in section 1-5 <https://library.municode.com/il/peoria/codes/code_of_ordinances?nodeId=CO_CH1GEPR_S1-5GEPE> of this Code for the second and each subsequent offense in any 180-day period.
FINANCIAL IMPACT: NA
NEIGHBORHOOD CONCERNS: Neighborhoods have expressed concerns about short term rentals. Multiple regulations have put in place to address some of these concerns.
IMPACT IF APPROVED: Staff will not issue citations for operating a short-term rental to property owners who do not have a special use for 90 days. Currently issued citations will be voided.
IMPACT IF DENIED: Staff will continue to issue citations for failure to comply and will move forward with the citations in the Hearing Officer process.
