BACKGROUND: The City Code currently requires permits for the placement of dumpsters and portable storage containers in the right-of-way, but typically the dumpster company informs the resident that they are responsible for submitting a permit application, which often happens hours before (or even after) the dumpster is placed. The permit also requires certification by the applicant about the location of the dumpster in relation to hydrants/intersections and that it be placed on boards to protect the pavement - items that are not entirely in the control of the resident but rather the entity placing the dumpster. The permit holder is also required to place barricades with flashing lights at the ends of the dumpster for visibility to adjacent traffic, which must be rented from a specialty construction supply rental operation.

In order to streamline the process for the residents and staff and require compliance with placement provisions (i.e. location from hydrants/intersections, boards protecting the pavement & barricades for visibility) from the entity that has greater control over and experience with those aspects, staff recommends that dumpster and portable storage container providers be required to be licensed and bonded with the City and to apply directly for applicable permits.

By being licensed and bonded, the City can better track & communicate applicable provisions with the contractors and will have recourse in the event that there is damage to City infrastructure or companies are deficient in applying for requisite permits.
