ACTION REQUESTED:
Title
Communication from the City Manager and Corporation Counsel with a Request to APPROVE a SETTLEMENT in JOHNSON v. CITY OF PEORIA.
Body
BACKGROUND:
Johnson v. Peoria, et al.: This case stems from the officer-involved shooting of Eddie Russell, Jr. in Sept. 2017. After robbing a local bank at gunpoint Russell walked to his mother’s nearby home. After a two hour stand-off and negotiation with PPD’s Special Response Team, Russell was shot as he emerged from the home and raised a gun at the officers. Russell’s mother (Johnson) brought a federal lawsuit. The case is defensible, but a settlement will end on-going litigation costs.
Negotiations with plaintiff have resulted in a tentative settlement of $415,000.00.
NEIGHBORHOOD CONCERNS: None.
IMPACT IF APPROVED: Settlement approval will bring closure to the existing case and end legal fees.
IMPACT IF DENIED: Litigation will proceed.
