Communication from the City Manager and Corporation Counsel with a Request to ADOPT an ORDINANCE Amending CHAPTER 27 (Taxation), ARTICLE XII (Motor Fuel Tax), of the CODE of the City of Peoria, Pertaining to PENALTIES FOR VIOLATION of Said Ordinance.

BACKGROUND:

The City has imposed a motor fuel tax on gasoline retailers since 1994 and in order to properly calculate said tax, dealers are licensed with the City. The licensee must attest that they will comply with all ordinances and laws of the State and United States. The Mayor or her designee is empowered to conduct hearings of gas station licensees when violations of the ordinance exist. Currently, the Mayor is only empowered to impose a fine or licensing penalty when a gasoline retailer fails to remit the proper motor fuel tax. Amending the ordinance to give the Mayor authority to impose fines or licensing penalties will provide greater regulation of gasoline retailers while also providing consistency with the license application requirements.

NEIGHBORHOOD CONCERNS: Various neighborhoods throughout the City have experienced increased violence, some notably concentrated at gas stations.

IMPACT IF APPROVED: The Mayor will have authority to fine or impose licensing penalties when a gas station violates any local ordinance or state or federal law.

IMPACT IF DENIED: The Mayor will have authority to fine or impose licensing penalties when a gas station violates any local ordinance or state or federal law. The Mayor will only have the ability to fine or impose licensing penalties when the licensee fails to pay motor fuel tax.
