A. APPROVE a Proposed HIGHWAY AUTHORITY AGREEMENT Between the City of Peoria and JAM PETROLEUM, INC. (JAM) for the Property Known as 6025 NORTH UNIVERSITY STREET, Peoria, Illinois.

B. ADOPT a Limited Area Groundwater ORDINANCE for Parcels: PIN 14-17-326-012, PIN 14-17-326-013 and PIN 14-17-326-014 (former parcel PIN 14-17-326-005 was subdivided into PIN 14-17-326-013 and PIN 14-17-326-014) and Portions of NORTHMOOR ROAD and UNIVERSITY STREET.

BACKGROUND:
As part of the State's Leaking Underground Storage Tank Remediation Program, JAM, the lessee of 6025 North University Street, seeks the following:

A. A Highway Authority Agreement with the City of Peoria that will put the public and future roadway construction entities/individuals on notice that there have been several gasoline/diesel fuel releases reported in the area and that caution should be taken if there is excavation in this area.

B. A limited area Groundwater Ordinance to prohibit the use of groundwater as a potable water supply by the installation or use of potable water supply wells or by any other method.

The theory of the program is that the cost of remedying the potential harm far exceeds any harm done by leaving the property in its present condition.

Per City policy, the laboratory results have been reviewed by an independent engineer, Anthony Negri, PE, of Eagle Environmental Consultants, LLC (Eagle). Mr. Negri submitted the following response to City Staff: "there are no engineering or apparent public safety reasons that would prohibit the City from entering into the Highway Authority Agreement and implementing a Groundwater Ordinance for a limited area."

FINANCIAL IMPACT: None. The requestor, JAM, paid Eagle's fees for the independent review.
