Title
Communication from City Manager and Director of Public Works with a Request to Accept a DEDICATION DEED from LFH-100 LLC for a Parcel of Land for a Public Street to Serve the GLENHAVEN COMMONS SUBDIVISION. (Refer to Annexation Agreement Resolution #05-248) [Council District 5]

Body
BACKGROUND: In 2005, City Council approved an annexation agreement for the subject property, which provided for access to Allen Road. More recently, a subdivision plat was approved noting this access in the form of a future private or publicly dedicated street. The developer has chosen to dedicate this future street to the public. The attached dedication plat illustrates the proposed public right-of-way connecting from Wilder Street to Allen Road. During approval of the subdivision plat, a right-of-way width of 50-feet and street width of 26-feet face of curb to face of curb were approved for either a private street or a public street.

FINANCIAL IMPACT: Future maintenance costs, including snow plowing.

NEIGHBORHOOD CONCERNS: None

IMPACT IF APPROVED: The Dedication Deed will be recorded in accordance with the Annexation Agreement.

IMPACT IF DENIED: A future street will not be dedicated to the public. The street may become a private street, which requires a private street maintenance agreement to be approved by City Council.
