BACKGROUND:
Petitioner: Anthony Rapplean

Background and request: Concurrent to this request, an administrative subdivision is being processed to divide the subject three lots into six. If the subdivision is approved, the subdivided lots will no longer meet minimum lot size requirements for the existing R-1 Zoning Classification; however the newly created lots will meet the requirements for the R-3 Zoning Classification. Therefore, the petitioner is requesting to rezone the subject lots from R-1 (Single Family) Residential to R-3 (Single Family) Residential.

Property characteristics: The subject properties are zoned R-1 (Single Family) Residential; and surrounded by R-3 (Single Family) Residential. From 1963-1990, the surrounding properties were zoned R-1 (Low Density) Residential; and prior to that, the area was not yet annexed into the City. A school is located to the west of the subject property.

Staff comments:
1. When evaluating whether a Zoning Map amendment is appropriate, the Commission should consider the holdings from the La Salle National Bank V. City of Highland Park case offer factors to consider in determining whether a rezoning is appropriate:
* Uses and zoning of nearby property
* Diminution of property values
* Promotion of public welfare
* Gain-loss balance (does the current or proposed zoning deny reasonable economic use)
