BACKGROUND:
The proposed amendments to Chapter 3 of the City Code will allow coffee shops to sell beer and wine for onsite consumption. Of course, the City Council would have to approve the site application for such coffee shop. Presently, if a coffee shop could not meet the definition of a restaurant because it did not have an adequate and sanitary kitchen with equipment such as a sink; refrigerator with the minimum capacity of 20 cubic feet; and oven with the minimum capacity of 4.3 cubic feet or a range or grill; the coffee shop would be restricted to a Class A (tavern) license. Such Class A (tavern) license does not fit into the business model of a coffee shop and thus, adding a Class "G-D" license for a coffee shop would allow the option of a coffee shop to add wine and craft beer to the menu.
For a house-keeping purpose, amendment to Section 3-7 of the City Code simply eliminates an outdated provision that prohibits the sale and service of alcohol to someone with legal disability or in need of mental treatment.
The proposed ordinance with the amendments was before the City Council at its meeting on May 10, 2016, for the first reading.

NEIGHBORHOOD CONCERNS: Not applicable.

IMPACT IF APPROVED: Coffee shops upon obtaining the appropriate site approval will be able to sell and serve wine and beer.

IMPACT IF DENIED: Coffee shops without a fully operating kitchen would be limited to a Class A (tavern) license.

ALTERNATIVES: None.
