Communication from City Councilwoman Beth Akeson with a Request to ADOPT an ORDINANCE Amending Ordinance No. 16,142 providing for COUNCIL RULES Pertaining to CONFLICT OF INTEREST.

BACKGROUND: Ordinance 16,142 sets out the rules for conduct of a City Council meeting. It also contains a section on voting that indicates “Every member, who shall be present when a question is stated from the Chair, shall vote thereon unless excused by Council or unless he has a conflict of interest as to the question, in which case, he shall not vote.” The rules do not contain a definition of conflict of interest, however. Corporation counsel is called on from time to time to provide guidance on whether a council member has an impermissible interest in matters he or she is being asked to vote upon. In order to provide a definition of conflict of interest, an amendment to the ordinance is proposed.
