Communication from the City Manager and Director of Public Works Requesting the Following:

A. APPROVE a Local Agency AGREEMENT for the JURISDICTIONAL TRANSFER of an Alley Remnant off SPALDING Avenue from the Municipal Street System to the State Highway System; and

B. ADOPT an ORDINANCE for a JURISDICTIONAL TRANSFER of the Southwesterly-most 33 Foot Long Section of the Alley that is Southwest of SPALDING AVENUE, Between MONROE STREET and MADISON AVENUE, from the Municipal Street System to the State Highway System. (Refer to #16-334) (Council District 1)

BACKGROUND: At its meeting on October 25, 2016 under Item No. 16-334, City Council approved a Resolution authorizing the Public Works Director to sign a Letter of Intent with IDOT to start the process for a Jurisdictional Transfer of City-owned right-of-way in an alley within the parcel bound by Spalding Avenue, Madison Avenue, Interstate 74, and Monroe Street. This was in order for IDOT to enter into a Lease Agreement for the development of the old Cornerstone property at 321 NE Madison Avenue for the Obed & Isaac's brewpub. At the time of the research for the lease agreement, IDOT discovered this small remnant of a vacated alley was still owned by the City of Peoria, within the IDOT property.

As a result of the 2016 Letter of Intent, IDOT undertook preparation of the plats and agreements for this jurisdictional transfer and city staff now brings forward the formal documents to complete same. The attached, proposed Ordinance for this Jurisdictional Transfer is recommended by Staff.

FINANCIAL IMPACT: There will be no cost to the City for this transfer. Future maintenance will also be eliminated.

NEIGHBORHOOD CONCERNS: N/A

IMPACT IF APPROVED: The City can record an Ordinance to remove this right-of-way from its road system and transfer the ownership and maintenance to the State of Illinois.
