(Council District 2)

Body
BACKGROUND: The applicant and owner, Matthew Dylewski requests to obtain a special use to use an existing single family dwelling with one bedroom as a short term rental. Stays for a period less than 30 consecutive days is considered a short term rental and requires special use approval.

The dwelling has one bedroom. The proposal is to allow up to 2 guests. Off-street parking is not available. On-street parking is allowed. The property is in the Cottage District Neighborhood Collective and in the Moss-Bradley Residential Association. The 3% cap on special use short term rentals allows 1 in the Cottage District. If approved, this request would be the first, and the cap in this neighborhood would be met. In the Moss-Bradley Residential Association the 3% cap allows 17 special use short term rentals. If approved, this would be the second in the Moss-Bradley Residential Association.

The Planning & Zoning Commission found that the request, in case PZ 1176-2022, met the Findings of Fact and voted 6-0 to approve the request subject to the following conditions:
1. Fire extinguishers shall be installed according to the 2018 International Fire Code Chapter 9, Section 906.
2. Interconnected smoke alarms shall be installed according to the 2018 International Fire Code Chapter 9, Section 907.
3. Carbon monoxide detector shall be installed according to the 2018 International Fire Code Chapter 9, Section 915.
4. Additional dwelling units cannot be added to the single family dwelling.
5. Occupancy of the short term rental shall not exceed two (2) guests.
