(Council District 2)

BACKGROUND: The applicant, Kristin Otto, on behalf of her husband Anthony Bleull, requests to obtain a special use to use an existing single-family dwelling as a short term rental. Renting all or part of a dwelling to transient guest(s) for a period less than thirty (30) consecutive days is considered a short term rental.

The dwelling has one bedroom. The proposal is to have no more than two guests. Parking is only available on-street. Waivers from front yard fence standards (height and material) are requested to allow the existing fences to remain. A condition is recommended to repair a section of the chain link fence. The property is in the Center Bluff Neighborhood Association. The Unified Development Code stipulates no more than 3% or 17 special use short term rentals in this neighborhood association. If approved, this would be the second special use approved for a short term rental in the Center Bluff Neighborhood Association.

The Planning & Zoning Commission found that the request, in case number PZ 641-2021, met the Findings of Fact and voted 7-0 to approve subject to the site plan and the following waivers and conditions:
1. Waiver to permit a 4 foot tall, wrought iron style fence in the front yard. Said waiver applies only to the existing location and length of the fence as identified on the site plan.
2. Waiver to permit a 3 foot tall chain link fence in the front yard. Said waiver applies only to the existing location and length of the fence as identified on the site plan.
